Warranty Policy For Refurbished Products
The Warranty Terms (“Warranty Terms”) set out herein below shall apply to you in respect of you purchase of any mobile device identified as ‘Refurbished’ on our store.
The Terms of use available at http://www.maxxmobile.net/terms (“Terms of Use”) are hereby incorporated by reference in to these Warranty Terms and shall apply to you; however, in the event of conflict between the Warranty Terms and the Terms of Use, these Warranty terms will prevail.
NOTWITHSTANDING ANYTING CONTAINED IN THE TERMS OF USE, OUR RETURN AND WARRANTY POLICY AVAILABLE AT http://www.maxxmobile.net/warranty-returns-policy , DOES NOT APPLY TO ANY REFURBHISHED MOBILE DEVICES SOLD, ON OUR STORE.
REFURBISHED MOBILE DEVICE
You understand that the product/device identified as ‘Refurbished’ on our store is refurbished, meaning it has been pre-owned and used before and may show signs of wear and tear, like scratches, discoloration, cosmetic damage, etc,. However, the product has been checked and tested by our suppliers to ensure the product functions properly and is in satisfactory condition (“Refurbished Mobile Device”).
WARRANTY
Except as otherwise provided herein, MaxxMobile warrants to you (i.e., You being the original buyer of the Refurbished Mobile Device) that the Refurbished Mobile Device you’re purchasing will be free form defect and workmanship, under normal use for a period of one (1) year from the date of purchase (“Warranty Period”). Except as otherwise provided, this warranty will be non- transferable.
THE MOBILE DEVICE SHALL BE NON-REFUNDABLE OR NON-RETURNABLE, EXCEPT IN CASE OF BREACH OF WARRANTY BY MaxxMobile AS PROVIDED ABOVE AND SUBJECT TO TERMS SET OUT HEREIN BELOW.
It is abundantly clarified that the returns under the BUYERS REMORSE POLICY are not accepted in respect of the REFURBISHED MOBILE Devices.
DOA (DEAD ON ARRIVAL) RETURNS
If you find that the Refurbished Mobile Device delivered to you is either defective or damaged and if you raise a claim within 7 days of delivery, upon our review and acceptance of the claim and providing you a return shipping label, you can return the device to us and we will replace the Refurbished Mobile Device with a same configuration (or with your consent similar i.e., with substantially similar features pre-owned, used and refurbished phone with similar technical specification) if it is found to be defective or damaged upon inspection. The eplacement of similar pre-owned or used phones is subject to availability. If there is no similar phone with similar configuration available with us, we will initiate the refund. There won't be any shipping cost charged to you if it is found to be defective or damaged in our inspection report and the claim was raised with seven (7) days of the delivery.
HOW TO MAKE A CLAIM
Step by step guide to return and claim the refund:
- Sign-in to view the order history.
- Locate the order that you would like to request an warranty claim and click the "Claim Warranty" button.
- Select the reason and upload an image (optional).
- Fill in the comment box that provides specific information about the issue you are having and as much detailed information as possible with the return request (upload proof and detail in comment box) and then click the "Continue" button.
- There may be some handling charges depending on the condition of the returned Product which you need to agree with before you submit the Claim Warranty request.
- When your Claim is approved, you will receive an email with your Return number and a return shipping label. You will be able to view the status of your Claim request in your order history throughout the process.
- Follow the steps mentioned in the email and return the product.
- Stick the shipping label on the pre-packaged product and drop-off the same to any nearest drop-off location (as per the service name mentioned in the email. Ex: FedEx or UPS or USPS).
- Keep the return record evidence if any with you and send us an email with as much detailed information as possible with the return request (upload proof and detail in comment box), so that we can quickly process your Claim.

No Trouble Found (NTF) FEE. upon review of a returned Refurbished Mobile Device under any warranty claim, in the event that, it is determined by us that there is No Trouble Found (NTF) with the Product as was claimed or alleged, we will return your Refurbished Mobile Device back to you subject to you paying the appropriate handling and return shipping fee or at our sole discretion refund the amount to you upon your payment of the NTF fee and handling and shipping fee as determined by us; which shall be subject to a minimum of $150 (USD ONE HUNDRED AND FIFTY).
Misused and Damaged phones - If the warranty claim in respect of any of the Refurbished Mobile Device is determined by us to be voided, due to one of the exceptions or exclusions covered under the “Warranty Exclusions” section below, depending on the condition of your returned Refurbished Mobile Device, we may in our sole discretion and assessment, either return your Refurbished Mobile Device, back to you, subject to you paying the appropriate handling and return shipping fee or refuse the return/refund and charge you the shipping costs, handling fee and a restocking and refurbishing fee; which shall be subject to minimum of 150%(USD ONE HUNDRED AND FIFTY) of the purchase price paid by you.
REMEDIES FOR BREACH OF WARRANTIES
MaxxMobile entire liability and your exclusive remedy for any breach of warranty shall be, at MaxxMobile option:
provided that the Refurbished Mobile Device is returned by you such place as MaxxMobile may direct with a copy of the sales receipt or dated itemized receipt. Shipping and handling charges may apply except where prohibited by applicable law
MaxxMobile may, at its option, replace your Refurbished Mobile Device, offer to provide a functionally equivalent pre-owned, used or refurbished product which is same (or with your consent similar i.e., with substantially similar features pre- owned, used and refurbished phone with similar technical specification), or repair any Refurbished Mobile Device with a refurbished or used parts as long as such parts are in compliance with the product’s technical specifications. Any replacement for the Refurbished Mobile Device will be warranted for the remainder of the Warranty Period (as defined herein above) or seven (07) days from the repair or replacement, whichever is longer.
WARRANTY EXCLUSIONS
This warranty doesn't cover issues, problems or damage which are:
(1) regular wear and tear or otherwise due to the normal aging of the Refurbished Mobile Device;
(2) to the protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship
(3) cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship;
(4) damage caused by use with a third party component or product that does not meet the specifications prescribed by the OEM of the Refurbished Mobile Device;
(5) damage caused by operating the Refurbished Mobile Device outside OEM’s published guidelines;
(6) accidents, misuse, or unauthorized alterations or repairs;
(7) due to improper use or maintenance, not following product instructions, or connecting to the wrong power source;
(8) due to using consumable items like batteries not recommended by the OEM of the Refurbished Mobile Device;
(9) loss of parts supplied with the Refurbished Mobile Device;
(10) parts, accessories and extras even if included with the refurbished iPhone;
(11) if we receive information from relevant public authorities or registries that the product has been stolen or if you are unable to deactivate passcode- enabled or other security measures designed to prevent unauthorized access to the Refurbished Mobile Device, and you cannot prove in any way that you are the authorized user of the product (e.g., by presenting proof of purchase).
WARRANTY INFORMATION, DISCLAIMERS AND LIMIATATION OF LIABILITY
EXCEPT FOR THE SPECIFIC WARRANTY PROVIDED ABOVE WHICH ARE EXTENDED TO SPECIFC PURCHASES AS IDENTIFIED WITH PURCHASE, ANY REFURBISHED MOBILE DEVICE OR ITEMS PURCHASED FROM OUR WEBSITE ARE MADE AVAILABLE ON “AS IS” BASIS AND NO OTHER WARRANTIES ARE PROVIDED ON SUCH REFURBISHED PRODUCTS OR ITEMS PURCHASED.
EXCEPT AS PROVIDED IN THIS WARRANTY POLICY DOCUMENT MaxxMobile, ON BEHALF OF ITSELF AND ITS VENDORS AND SUPPLIERS (COLLECTIVELY MaxxMobile) MAKES NO WARRNATIES WHATSOEVER, AND TO THE EXTENT PERMITTED BY LAW, MaxxMobile IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED OR USED WITH OEM PRODUCTS AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. WE DO NOT MANUFACTURE OUR PRODUCTS. THE ONLY WARRANTIES APPLICABLE TO OUR PRODUCTS ARE THOSE EXTENDED BY THE MANUFACTURERS. WE HAVE NO LIABILITY, THEREFORE, IN CONNECTION WITH PRODUCTS OR FOR MANUFACTURERS' ACTS OR OMISSIONS. WE MAKE NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND SERVICES PROVIDED HEREUNDER OR ANY SOFTWARE USED IN CONNECTION THEREWITH, INCLUDING, BUT NOT LIMITED TO, AND TO THE EXTENT PERMITTED BY LAW, WARRANTY OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, QUALITY, NON-INFRINGEMENT, PERFORMANCE OR ACCURACY. WE EXPRESSLY DISCLAIM ANY AND ALL IMPLIED WARRANTIES. WE DO NOT PROMISE ERROR-FREE OR UNINTERRUPTED SERVICE AND DO NOT AUTHORIZE ANYONE TO MAKE WARRANTIES ON OUR BEHALF.
NO OTHER WARRANTIES
No MaxxMobile dealer, agent, or employee is authorized to make any modification, extension, or addition to this warranty.
These warranty terms constitute the entire agreement between you and us regarding the warranty of the Product and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written.
